Can I apply for an investor visa if I am already in the U.S. on another visa?​

Yes, it’s possible to apply for an investor visa such as the EB-5 visa while already in the U. S on another visa. If you’re currently in the U.S under a valid non immigrant visa like a tourist or student visa, you may be able to apply for a change of status to an EB-5 investor visa without leaving the country. This process involves submitting the I-526 form, the “ Petition by Alien Entrepreneur” which demonstrates that you meet the EB-5 programs requirements, including making a substantial investment in a U. S business and creating jobs for American workers. 

Additionally, since the reforms to the EB-5 program in 2022,you can file the I-526 and I-485 forms (Application to register permanent residence or adjust status) simultaneously, allowing you to live and work in the U.S, while your petition is being processed. However, processing times for these applications can be lengthy, often taking several years. 

It’s important to maintain your legal status throughout this process, and it’s highly recommended to consult an immigration attorney to ensure that your application is properly prepared and meets all current requirements.
