Are there any restrictions on the type of business activities I can engage in under an investor visa?​

The EB-5 investor visa program allows you to invest in a for-profit business that is “doing business” and other criteria. The business must be a new commercial enterprise that was created after November 29, 1990, or is a significantly expanded or restructured business enterprise. A new commercial enterprise must create at least 10 full-time jobs for U.S. workers within 2 years. Passive investments where you will not be engaged in the day-to-day management of the business are not permissible. The business cannot engage in unlawful activities, such as illicit drug dealings or unregulated gaming. There must be active operations for an investment in real estate, such as hotels or mixed-use development, rather than simply purchasing the property for appreciation. The business must meet legal and operational aspects associated with startup direct investments in order for it to qualify for the EB-5 investor program.
