What are the ethical considerations for employers sponsoring foreign workers?

Fair compensation and treatment are of course basic rights, foreign workers must be paid at least as much as, if not more than, the prevailing wage, and be provided benefits and working conditions similar to those of their U.S. counterparts. Both a legal and an ethical requirement is that the job opportunity be bona fide. Transparency and integrity in dealing with the sponsored employee are also essential.

Ethical employers will inform the employee openly about the sponsorship terms and provide them with copies of all applications submitted on their behalf. The employer must not pass on prohibited costs to the employee and must fulfill all commitments in the event of termination. Respect for the individual’s situation and privacy is important.

When recruiting foreign workers, certain ethical principles apply, such as not charging recruitment fees to applicants and ensuring that all employment contracts are clear and fair. These principles include equitable treatment, effective communication, compliance with legal and human rights obligations, and protection from discrimination or exploitation.
