To remove conditions on the permanent residency obtained through the EB-5 Immigrant Investor Program, you must file Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status, within the 90-day period immediately before the second anniversary of the conditional permanent residency. The petition will need to include evidence that the investment was sustained for two years/ the business was operational and created the requisite number of jobs (typically 10 full-time U.S. jobs), and the investment was active and in good faith. Once USCIS has reviewed the I-829 and the supporting documents, they may approve removal of conditions and grant you a permanent green card. An interview may, in some cases, be required.
